I talked to Brendan Doherty, a professor of political science at the United States Naval Academy and author of the books, “The Rise of the President’s Permanent Campaign” and “Fundraiser in Chief: Presidents and the Politics of Campaign Cash,” about why early presidents stayed off the trail and how this became the permanent campaign. DOHERTY: In the early decades of the republic, presidential candidates adhered to the norm that they should not actively campaign for office. A federal appeals court on Friday upheld the contempt conviction of Stephen K. Bannon, a longtime adviser to former President Donald J. Trump, for having defied a subpoena from the Jan. 6 House select committee, a ruling that could lead to Mr. Bannon serving a four-month term in prison. The decision by the court means that Mr. Bannon could soon become the second former Trump aide to be jailed for ignoring a subpoena from the committee. The House panel sought his testimony as part of its wide-ranging investigation into Mr. Trump’s efforts to remain in power after losing the 2020 election, and its explosive hearings two years ago previewed much of the evidence used against Mr. Trump in a federal indictment filed last summer accusing him of plotting to overturn his defeat. In March, Peter Navarro, who once worked as a trade adviser to Mr. Trump, reported to federal prison in Miami to begin serving his own four-month prison stint after a jury found him guilty of contempt of Congress for ignoring one of the committee’s subpoenas. The judge who oversaw Mr. Bannon’s trial had allowed him to remain at home during the appeal of his conviction and is now in a position to force him to surrender.

The Major Supreme Court Cases of 2024No Supreme Court term in recent memory has featured so many cases with the potential to transform American society. In 2015, the Supreme Court limited the sweep of the statute at issue in the case, the Sarbanes-Oxley Act of 2002. A federal appeals court on Thursday rejected a request by Hunter Biden to toss the pending criminal gun case against him, saying that his appeal was premature. The ruling clears the way for Hunter Biden's trial in the case to start on June 3 in U.S. District Court in Delaware. Biden is the son of President Joe Biden. The appeals panel, whose decision was unanimous, did not rule on the merits of Biden's arguments that the indictment should be dismissed. Trump’s lawyers are urging the full panel of appellate judges to rule on the constitutionality of the gag order, people familiar with the matter say. Previously, Trump’s lawyers asked an appeals court judge to take emergency action and stop the trial so they could appeal the gag order. The Democrat-controlled board also affirmed the judge's ruling that Apple illegally barred workers at the World Trade Center store from distributing union flyers. At least two Apple stores in the U.S. have unionized since 2022, and unions are working to organize several other locations including the World Trade Center store. The independent Oversight Board that hears appeals about content decisions on Facebook and Instagram said Tuesday it would consider whether the pro-Palestinian phrase "from the river to the sea" violates the platforms' rules including their ban on hate speech. In each of the three cases, other Facebook users reported the phrase, saying it violated platform rules on hate speech, incitement or violent organizations. The users opposed to the phrase then appealed to the Oversight Board. One of the Facebook posts being reviewed by the Oversight Board received about 8 million views, the board said. In one of its most significant decisions, the Oversight Board in 2021 upheld the suspension of former President Donald Trump from Meta's platforms but ruled that it was inappropriate to make the ban indefinite.

He learned late Tuesday afternoon that Judge Aileen Cannon, whom he appointed, indefinitely postponed a trial in his classified documents case in Florida. She told the jury Tuesday about a $130,000 hush money payment she received from Cohen before the 2016 election. But prosecutors allege Trump falsified business records to hide it and to mislead voters in an early bout of election interference. The judge complained that the ex-president was “cursing audibly” during Daniels’ testimony and was shaking his head. “Am I correct that you hate President Trump?” Necheles asked.

If it loses, TikTok could be banned from US app stores unless its Chinese parent company, ByteDance, sells the app to a non-Chinese entity by mid-January 2025. But Virginia Democratic Sen. Mark Warner, an advocate for the TikTok legislation, said in remarks on the Senate floor in April that the briefings provided critical insight into the risk TikTok poses. US policymakers have described the law at issue as a forced divestiture of TikTok, not an outright app ban. Some US officials have been trying to ban TikTok from the United States since 2020, when former President Donald Trump moved to block the app by executive order. (Trump has since reversed his position, saying a TikTok ban would only help Meta, a company Trump blames for his 2020 election defeat.)
